Valdez & Associates, Inc. (“Valdez & Associates,” “we,” “us”) operates valdezandassociates.com (the “Site”). This policy explains what information we collect when you use the Site, how we use it, and the choices you have. By using the Site you agree to this policy.

Information we collect

Information you give us

When you fill out a form on the Site, such as the contact form, a home valuation request, a property inquiry, or a request about rentals or property management, we collect what you enter: typically your name, email address, phone number, a property address, and your message. You decide what to include.

Information collected automatically

• Analytics. We use Google Analytics to understand how visitors use the Site, such as which pages are viewed, how long visits last, and the general region a visit comes from. IP addresses are anonymized before they are stored. Google's use of this data is described in Google's privacy policy.
• Spam protection. Our forms use Cloudflare Turnstile to tell people from automated bots. Turnstile may collect limited technical information about your browser and device for that purpose, as described in Cloudflare's privacy policy.
• Server logs. Our hosting provider records standard technical details of each request, including IP address, browser type, and the pages requested, for security and troubleshooting.

How we use information

• To respond to your inquiry and provide the real estate, rental, or property management services you asked about.
• To send you information you requested, such as listing details, a home valuation, or follow-up about a property.
• To operate, secure, and improve the Site.
• To comply with legal obligations, including real estate licensing and record-keeping requirements in New Mexico.

We do not sell your personal information, and we do not share it with third parties for their own marketing.

Who we share information with

• Service providers that help us run the Site and our business, such as our email delivery, hosting, analytics, and spam-protection providers. They may use your information only to perform services for us.
• Our brokers and staff, so the right person can respond to you.
• Parties to a transaction, such as a lender, title company, inspector, or the other party's broker, when you engage us and the information is needed to complete your transaction.
• Legal requirements. We may disclose information when required by law, subpoena, or a request from a government authority, or to protect our rights, property, or safety or those of others.

Property listings and the MLS

Property listings on the Site are provided through an Internet Data Exchange (IDX) feed from the Santa Fe Association of REALTORS® Multiple Listing Service, delivered by our IDX provider, Buying Buddy. If you create a saved search, favorite a property, or sign up for listing alerts through the listing tools, that information is collected by Buying Buddy on our behalf and is subject to Buying Buddy's privacy policy as well as this one.

Rental and owner portals

Rental applications, resident payments and maintenance requests, and owner statements are handled through AppFolio, a third-party property management platform. Information you enter in those portals, including payment details and application information, is collected and processed by AppFolio under AppFolio's privacy policy. We do not store your payment card or bank details on this Site.

Cookies

The Site uses a small number of cookies and similar technologies: analytics cookies set by Google Analytics, functional cookies used by the listing tools to remember your saved searches and favorites, and cookies used within the AppFolio portals. You can block or delete cookies in your browser settings. Doing so may limit some features, such as saved searches.

Your choices

• Email. You can ask us to stop contacting you at any time by replying to any message or emailing [email protected].
• Listing alerts. Every alert email includes an unsubscribe link.
• Analytics. You can opt out of Google Analytics with the Google Analytics opt-out browser add-on.
• Access and deletion. You may ask us what personal information we hold about you and request that we correct or delete it. We will honor requests unless we must keep the information for a legal, regulatory, or transaction-record reason, which real estate brokerages are required to do for a period of years.

Data retention and security

We keep inquiry information for as long as needed to respond to you and for a reasonable period afterward. Records tied to a real estate transaction are kept for the period required by New Mexico law. We use reasonable administrative and technical safeguards, including encrypted connections, to protect your information. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security.

Children

The Site is intended for adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided information to us, contact us and we will delete it.

Links to other sites

The Site links to third-party sites, including social media, the Better Business Bureau, and the portals described above. Their privacy practices are their own, and we encourage you to read their policies.

Changes to this policy

We may update this policy from time to time. The date at the top shows when it was last revised. Material changes will be posted on this page.
