These terms govern your use of valdezandassociates.com (the “Site”), operated by Valdez & Associates, Inc. (“Valdez & Associates,” “we,” “us”). By using the Site you accept these terms. If you do not agree, please do not use the Site.

About us

Valdez & Associates, Inc. is a licensed real estate brokerage and property management company in Santa Fe, New Mexico, licensed by the New Mexico Real Estate Commission. Our office is at 2235 Henry Lynch Road, Santa Fe, NM 87507.

Information on the Site

The Site is provided for general information about our services, the Santa Fe area, and properties for sale or rent. Nothing on the Site is legal, tax, financial, or investment advice. Market commentary, neighborhood descriptions, event listings, and similar content reflect our general knowledge at the time of writing and may change. Before making a decision about a property, verify the details that matter to you with us and with the appropriate professionals.

Property descriptions, measurements, school information, taxes, and fees come from sources we believe to be reliable but are not guaranteed. Buyers and tenants should independently verify anything they rely on.

MLS listing data

Listings displayed on the Site come from the Internet Data Exchange (IDX) program of the Santa Fe Association of REALTORS® Multiple Listing Service (the “MLS”). By viewing listings you agree to the following:

• The listing data is copyrighted by the Santa Fe Association of REALTORS® MLS and is protected by United States and international copyright law. All rights are reserved.
• Listing information is provided exclusively for consumers' personal, non-commercial use and may not be used for any purpose other than to identify prospective properties you may be interested in purchasing or renting.
• Properties marked with the IDX logo or identified as listed by another brokerage are held by brokerage firms other than Valdez & Associates. The name of the listing brokerage is shown with each such listing.
• Listing data is deemed reliable but is not guaranteed accurate by the MLS or by Valdez & Associates. Listings may be sold, withdrawn, or changed without notice, and the data on the Site may lag the MLS.
• You may not copy, scrape, reproduce, redistribute, or retransmit listing data, in whole or in part, by any means.

Fair housing

Valdez & Associates supports and complies with the federal Fair Housing Act, the New Mexico Human Rights Act, and applicable local law. We do not discriminate on the basis of race, color, religion, sex, sexual orientation, gender identity, national origin, ancestry, familial status, disability, spousal affiliation, or any other protected class in the sale, rental, or management of housing.

Rental and owner portals

Rental applications, resident payments, maintenance requests, and owner statements are handled through AppFolio, a third-party platform reached through links on the Site. Your use of those portals is subject to AppFolio's own terms and privacy policy and to the terms of your lease or management agreement with us, which control if they conflict with these terms.

Using the Site

You agree not to:

• use the Site for any unlawful purpose or in a way that could damage, disable, or impair it;
• submit false, misleading, or abusive content through our forms, or submit forms on behalf of someone else without their permission;
• use automated tools, bots, or scrapers to access the Site or collect data from it;
• attempt to gain unauthorized access to any part of the Site, its servers, or connected systems.

Our content

Except for MLS listing data and third-party content, the text, photographs, graphics, logos, and design of the Site belong to Valdez & Associates or are used with permission and are protected by copyright and trademark law. You may view and print pages for your personal use. Any other use, including republication or commercial use, requires our written permission.

Copyright complaints

If you believe material on the Site infringes a copyright you own, send a notice under the Digital Millennium Copyright Act to [email protected] or by mail to our office address, including: identification of the copyrighted work; identification of the material you believe infringes and where it appears on the Site; your name, address, telephone number, and email; a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature.

Forms and communications

Submitting a form on the Site does not create an agency relationship or a contract between you and Valdez & Associates. Agency relationships in New Mexico are established only by a written agreement, and we will provide the required brokerage relationship disclosures before you engage us. By providing your phone number or email address you agree that we may contact you about your inquiry.

Third-party links and services

The Site links to and embeds services operated by others, including Buying Buddy (listings), AppFolio (portals), Google (maps and analytics), and social media platforms. We are not responsible for their content, availability, or practices.

Disclaimer of warranties

The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, Valdez & Associates, its owners, brokers, and employees will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits or data, arising from your use of or inability to use the Site or any content on it, even if advised of the possibility of such damages. Nothing in these terms limits liability that cannot be limited under applicable law.

Governing law

These terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles. Any dispute relating to the Site will be brought in the state or federal courts located in Santa Fe County, New Mexico, and you consent to their jurisdiction.

Changes

We may revise these terms at any time by posting an updated version on this page. The date at the top shows when they were last revised. Continued use of the Site after a change means you accept the revised terms.
